OtakuFunk respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

2. Our Content Sources

Jikan API Integration: Our anime information, including titles, descriptions, scores, and metadata, is sourced from the Jikan API, which provides public data from MyAnimeList. We do not host copyrighted anime content, videos, or episodes.

User-Generated Content: Our platform allows users to create discussions, reviews, and share opinions about anime. We take copyright infringement seriously in all user-generated content.

3. What We Don't Host

OtakuFunk does not host, stream, or distribute copyrighted anime episodes, movies, or other copyrighted audiovisual content. We are a community discussion platform that uses publicly available anime metadata.

4. Filing a DMCA Notice

If you believe that content on our platform infringes your copyright, you may submit a DMCA takedown notice. Your notice must include:

Required Information

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing material and information to locate it
  • Your contact information (address, phone number, email)
  • A good faith belief statement that the use is not authorized
  • A statement that the information is accurate and you are authorized to act

5. Counter-Notification Process

If you believe your content was removed in error, you may file a counter-notification:

Counter-Notice Requirements

  • Your physical or electronic signature
  • Identification of the removed content and its former location
  • A good faith belief that removal was due to mistake or misidentification
  • Your contact information
  • Consent to jurisdiction in your district court
  • Agreement to accept service of process from the complainant

Counter-Notice Timeline

After receiving a valid counter-notification, we will forward it to the original complainant. If they don't file a court action within 10-14 business days, we may restore the content.

6. Repeat Infringer Policy

We have a policy of terminating accounts of users who are repeat copyright infringers. We may also remove content and terminate accounts that receive multiple valid DMCA notices.

Strike System

  • First Strike: Warning and content removal
  • Second Strike: Temporary account suspension
  • Third Strike: Permanent account termination

7. Fair Use and Commentary

Our platform encourages legitimate discussion and criticism of anime content. We recognize that some uses may qualify as fair use under copyright law, including:

  • Critical reviews and commentary
  • Educational discussions about anime
  • Parody and transformative content
  • News reporting about anime industry

However, fair use is determined on a case-by-case basis and doesn't automatically protect all uses of copyrighted material.

8. False Claims and Perjury

9. International Copyright

Beyond DMCA compliance, we proactively moderate content to ensure it meets our community standards:

  • Regular review of user-uploaded content
  • Automated detection of potentially infringing material
  • Community reporting mechanisms
  • Collaboration with rights holders for content protection

11. Safe Harbor Provisions

OtakuFunk qualifies for safe harbor protections under the DMCA as a service provider that:

  • Does not have actual knowledge of infringing activity
  • Does not receive financial benefit directly from infringing activity
  • Responds expeditiously to remove infringing content when notified
  • Has implemented a repeat infringer policy
